29 CFR 1910.132(a):     Protective equipment was not maintained in a sanitary and reliable condition:    Gonzales County, Well Name: Whyburn, Unit #7H, 29.35N, -97.44W: On or about 4 April 2012, and at times prior thereto, while casing operations were commencing at an oil and gas Apex 1500 derrick rig, the employer did not maintain fall protection safety equipment in a sanitary and reliable condition. The lanyard's start of service date could not be determined and no record of periodic inspection of the equipment was kept. The equipment was allowed to become soiled, saturated with oil based liquids, and subjected to environmental factors, including UV rays, exposing the employees utilizing such equipment to a fall hazard of approximately 50 feet.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure safety equipment is maintained in a sanitary and reliable condition; and used in accordance with the manufacturer's instructions or taken out of service if it cannot be maintained.

29 CFR 1904.7(b)(3):     When an injury or illness involved one or more days away from work, the employer did not record the injury or illness on the OSHA 300 Log, or on an equivalent form, with a check mark in the space for cases involving days away and an entry of the number of calendar days away from work in the number of days column.    At the inspection site, the OSHA Form 300 Log of Work Related Injuries and Illnesses was not completed accurately and completely.    a) For calendar year 2011, case#40 had 2 days recorded in column K (Number of days away from work) but column H (Days away from work) was not checked. The employer should have checked ONLY column H for case# 40 instead of checking column I (Job transfer or restriction).    b) For calendar year 2010, case#50 had 38 days recorded in column K (Number of days away from work) but column H (Days away from work) was not checked. The employer should have checked ONLY column H for case# 40 instead of checking column I (Job transfer or restriction).    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure recordable injuries or illnesses are recorded accurately for the classification of the case.

29 CFR 1904.29(b)(1):     A Log of all recordable work-related injuries and illnesses (OSHA Form 300 or equivalent) was not completed in the detail as required by the regulation.    At the inspection site, for calendar year 2011, cases 10 and 14 on the OSHA 300 Log of Work Related Injuries and Illnesses were marked incorrectly for columns M1 through M6 (Check the "Injury" column or choose one type of illness). Both were marked M6 (All other illnesses) and instead should have been marked M1 (Injury).    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure the correct entries are made for columns M1 through M6 on the OSHA 300 Log.

29 CFR 1904.32(b)(6):     At the end of each calendar year, the employer did not post the OSHA 300A Summary by February 1 as required by 1904.32(a)(1) and/or keep it posted for three months, until May 1, as required by 1904.32.    At the inspection site, for calendar year 2011, the employer signed and dated the Summary as 1/31/2011, when it should have been 1/31/2012.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure the Summary is signed and posted between 1/1/2012 and 2/1/2012.
