OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a) Warehouse Alabama Crown Distributing: On or about April 11, 2012 and at times prior the employer exposed his employees to struck-by hazards in that employees were allowed to walk and work around steel storage racks (Section 1000) that had multiple damaged columns and angle braces. b) Warehouse Alabama Crown Distributing: On or about April 11, 2012 and at times prior the employer exposed his employees to struck-by hazards in that employees were allowed to walk and work around steel storage racks (Section 5000) that had multiple damaged columns and angle braces. c) Warehouse Alabama Crown Distributing: On or about April 11, 2012 and at times prior the employer exposed his employees to struck-by hazards in that employees were allowed to walk and work around steel storage racks (Section 6000) that had multiple damaged columns and angle braces.

29 CFR 1910.178(p)(1): Where powered industrial trucks were found to be in need of repair, defective, or in any way unsafe, the trucks were not taken out of service until they had been restored to safe operating condition: a) Warehouse Alabama Crown Distributing: On or about April 11 and at times prior the employer failed to take out of sevice a Clark forklift for not having a working horn. b) Warehouse Alabama Crown Distributing: On or about April 11 and at times prior the employer failed to take out of sevice a Hyster 50 forklift for not having a working horn.
