29 CFR 1926.100(a):  Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:  On or about April 12, 2012, and at times prior thereto, employees performing framing activities were exposed to head injury from overhead hazards and impact hazards.  Potential falling objects from the roof included, but are not limited to, hand tools, a pneumatic nail gun, and lumber.

29 CFR 1926.102(a)(1):  Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  On or about April 12, 2012, and at times prior thereto, employees operating a pneumatic nail gun and portable hand saw for framing activities were not provided, nor required to wear, eye protection.  Employees were exposed the hazard of being struck by flying projectiles.

29 CFR 1926.501(b)(13):  Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b)  Note:  If using these systems was infeasible or created a greater hazard, the employer should develop and implement a fall protection plan meeting the requirements of paragraph (k) of 1926.502.  a) On or about April 12, 2012 and at times prior thereto, employees were observed performing framing activities on the existing rafters without the protection of a warning line, guardrail system, or personal fall arrest system.  The framing work included using a pneumatic nail gun and hand tools.  Employees were exposed to a fall from the roof edge of approximately 25 feet to the ground.  b) On or about April 12, 2012 and at times prior thereto, an employee was observed climbing rafters of a structure on the second floor without a personal fall arrest system.  The employee was performing framing activities white using a pneumatic nail gun was exposed to an approximate 30 foot fall to the ground.  c) On or about April 12, 2012 and at times prior thereto, an employee was observed cutting wooden panels on the second floor without a guardrail system around the open sides, exposing the employee to a 10 foot fall to the ground.

29 CFR 1926.21(b)(2):  The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  On or about April 12, 2012  and at times prior thereto, employees were exposed to a fall hazard of approximately 30 to 10 feet high, while framing near the edge of a residential home under construction.  The employer did not instruct the employees on the requirements of fall protection or the recognition of fall hazards.
