29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) On or about April 12, 2012 and times prior at 135 Cloverhill Dr., Montgomery: The employer failed to ensure employees accessing a balcony 9 feet 10 inches above the ground were protected from falls exposing them to the hazards of falls. (b) On or about April 12, 2012 at 135 Cloverhill Dr., Montgomery: The employer failed to ensure employees installing sheathing on a 6:12 pitch roof with a 18 feet 8 inch fall eave to ground were protected from fall which exposed them to the hazards associated with falls.
