29 CFR 1926.501(b)(10):     Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.    (a)  Jobsite, Forest Hills Plaza, Pittsburgh, PA:  On or about 04/05/12, employees engaged in roofing activities on a low slope roof with the dimensions of 20' x 100' were not protected from falling approximately 20 feet to the ground below.  A parapet wall of approximately 28 inches in height did not provide adequate fall protection and a safety monitor was not being used to warn employees who were working at the edge throwing roofing debris into a dumpster positioned on the ground below.

29 CFR 1926.503(c)(3):     Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  Note: The following appendices to subpart M of this part serve as non-mandatory guidelines to assist employers in complying with the appropriate requirements of subpart M of this part. [59 FR 40738, Aug. 9, 1994; 60 FR 5131, Jan. 26, 1995]    (a) Jobsite, Forest Hills Plaza, Pittsburgh, PA:  On or about 04/05/12, retraining had not been conducted for employees when inadequacies in the employees' knowledge or use of fall protection systems indicated the employees had not retained the requisite understanding or skill.    Employees were working on a roof without fall protection systems in place, exposing them to fall hazards of approximately 20 feet and this condition indicated that the employees had not retained an understanding or skill of the use of fall protection equipment and systems to be used to protect themselves.

(a) Jobsite, Forest Hills Plaza, Pittsburgh, PA:  On or about 04/05/12, the employer did not implement, develop or initiate a safety and health program that includes, but is not limited to: inspections of the jobsite, materials, equipment, tools, or machinery by a competent person, training for employees, or methods to address hazardous, unsanitary or dangerous conditions at the work site.
