29 CFR 1926.20(b)(2):     29 CFR 1926.20 (b)(2) The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.    a)  300 5th Avenue, Bradley Beach, NJ:  The employer did not initate a program that required frequent and regular inspectioins of the job site.  The worker on the job site was exposed to a fall hazard, observed on or about 4/17/12.     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13):     29 CFR 1926.501 (b)(13) Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.    a)  300 5th Avenus, Bradley Beach, NJ:  An employee was not utilizing fall protection when removing the roofing material from a residential home.  The employee was working at a height greater then 25 feet to the ridge and 23.3 feet to the first eave, observed on or about 4/17/12.
