29 CFR 1926.303(b)(1): Grinding machines shall be equipped with safety guards in conformance with the requirements of American National Standards Institute, B7.1-1970, Safety Code for the Use, Care and Protection of Abrasive Wheels, and paragraph (d) of this section. On or about April 09, 2012, at 4852 Veterans Blvd in Metairie, LA; the employer did not ensure that a portable grinder in use was equipped with a guard. The employee was installing a canopy for a restaurant.

29 CFR 1926.451(g)(4)(iii): When midrails, screens, mesh, intermediate vertical members, solid panels, or equivalent structural members are used, they shall be installed between the top edge of the guardrail system and the scaffold platform: On or about April 09, 2012, at 4852 Veterans Blvd in Metairie, LA; the employer did not ensure that a scissors lift in use was equipped with standard guardrails. The security chain (midrail) was not attached across the entrance for an employee installing an overhead canopy at a height of approximate 12 feet.
