29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks. a) On or about April 16, 2012, the operator did not first ensure that the load being maneuvered by the fork lift was ready to be moved and completely detached from the synthetic tie downs straps used to secure the load to the truck bed during transportation. While maneuvering the load off the flatbed truck the hook end of the tie down became caught on the bottom edge of the metal surround cabinet and caused the load to tip over on employee standing beside the load. Reference ANSI B56.1-2005 chapter 5 Operating safety Rules and practices. 5.1 Operator Responsibility 5.1.1 Safe operation and 5.1.2 Operator shall be aware of hazardous condition in order to protect himself, other personnel, the truck, and other materials.
