29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    A. Nick Panos worksite located at 2750 Pickle Rd., Oregon, Ohio: On or about April 5, 2012, the employer did not ensure employees wore proper eye protection while operating a pneumatic nail guns while installing weatherproofing on the two story multi-family residential structure. The employees were exposed to potential flying object hazards while operating the pneumatic fasteners.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provisionin paragraph (b) of this section provides for an alternative fall protection measure.     A. Nick Panos worksite located at 2750 Pickle Rd., Oregon, Ohio: On or about April 5, 2012, the employer did not ensure employees were protected from fall hazards while installing weatherproofing on the two story multi-family residential structure. The employees were exposed to a fall distance of approximately 15.00 feet on the west side of the 4/12 pitch roof.
