29 CFR 1926.100(a):     Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:    On or about 18 April 2012, and at times prior thereto, two workers were performing stucco work on a two tier tubular welded frame scaffold without the use of hard hats where tools and materials were located on the second level platform of the scaffold above them, exposing the workers to the hazards of being struck by falling tools, debris or materials.

29 CFR 1926.451(h)(2)(ii):     A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below.    On or about 18 April 2012, and at times prior thereto, four workers were performing stucco work on a two tier tubular welded frame scaffold without the use of toeboards where tools and materials were located on the second level platform of the scaffold while others were underneath, exposing the workers to the hazards of being struck by falling tools, debris or materials.

29 CFR 1926.451(b)(1):     Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)    On or about 18 April 2012, and at times prior thereto, four workers were performing stucco work while on the second level of a two tier tubular welded frame scaffold that was not fully planked at the level they were working at, exposing the workers to a fall hazard of approximately 15 feet.

29 CFR 1926.451(e)(1):     When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.      On or about 18 April 2012, and at times prior thereto, four workers were performing stucco work at the second level of a two tier tubular welded frame scaffold, without the use of a ladder to access, exposing the workers to a fall hazard of approximately 15 feet to the concrete surface below.
