OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees.      On or about April 16, 2012, at 136 Main St. Van Alstyne, Texas: employees were engaged in the demolition of a second level CMU wall section on a commercial building that was not laterally braced or self-supported.  The employees were exposed to crushing hazards.      Among other methods, one feasible and acceptable method to correct this hazard is to install lateral bracing in accordance with the American National Standard, Recommended Practice A10.6-2006, Section 10.4.2.

29 CFR 1926.453(b)(2)(v):  A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift.      On or about April 16, 2012, at 136 Main St. Van Alstyne, Texas: employees were engaged in demolition activities on a commercial building from a man-lift without a personal body harness or body belt with a lanyard.  The employee was exposed to fall hazards of 13 to the concrete below.

29 CFR 1926.503(a)(2)(i): Employees were not trained, as necessary, by a competent person qualified to recognize the nature of fall hazards in the work area.       On or about April 16, 2012, at a workplace located at 136 Main St., Van Alstyne, Texas: the employer, whose employees were engaged in demolition activities on a commercial building from a man-lift, did not provide a personal body harness or body belt with a lanyard exposing the employees to a fall hazard of 13 feet.  The employer did not provide training to the employees on recognizing and correcting hazards associated from falls.
