29 CFR 1926.404(b)(1)(i):     Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites.      a) On or about 4/17/12 in the 5th floor Janitors Room on construction site at Ellicott & Goodrich Streets (UB Space Build-  out), Buffalo, NY: An employee used a Hitachi Mitre Saw to cut pieces of aluminum. The saw was connected to 120-volt ac power via a blue extension cord which was plugged into a wall receptacle in the adjoining room. No GFCI or assured equipment grounding program was being used.    NO ABATEMENT CERTIFICATION REQUIRED
