29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):    Howell Custom Builders Inc, at 155 Peakview Drive, Berthoud, CO: On 4/18/12 Howell Custom Builders Inc did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them).  Employees of True Built Custom Builders Inc and Howell Custom Builders Inc were installing exterior sheathing on the second level of a residential structure.  An employee utilized a ladder to access the first floor's roof.  An employee worked upon a platform elevated by a rough terrain forklift.  The employer did not initiate and maintain a safety program that provided for inspections of the jobsite.  This condition exposed an employee of Howell Custom Builders Inc to an approximate eleven foot fall hazard.

An employee of Howell Custom Builders Inc was using a circular saw to cut OSB sheathing while working upon a metal six foot by sixteen foot metal fabricated platform elevated by a True Built Custom Builders Inc owned and operated Ingersoll Rand VR-60B rough terrain forklift.  The employer utilized a non-manufacturer approved and non-manufacturer fabricated platform.  The employer did not ensure that the employee was protected from an approximate eleven foot fall hazard.

An employee of Howell Custom Builders Inc was using a circular saw to cut OSB sheathing while working upon a metal six foot by sixteen foot metal fabricated platform elevated by a True Built Custom Builders Inc owned and operated Ingersoll Rand VR-60B rough terrain forklift.  Neither guardrails nor a personal fall arrest system were utilized.  The employee of Howell Custom Builders Inc was not provided fall protection while working upon the elevated platform.  The employer did not ensure that the employee was protected from an approximate eleven foot fall hazard.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    Howell Custom Builders Inc, at 155 Peakview Drive, Berthoud, CO: On 4/18/12 Howell Custom Builders Inc did not ensure that portable ladders used for access to an upper landing surface had ladder side rails that extended at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access.  Employees of True Built Custom Builders Inc and Howell Custom Builders Inc were installing exterior sheathing on the second level of a residential structure.  An employee of Howell Custom Builders Inc utilized a ladder to access the first floor's roof.  The ladder's side rails extended approximately eighteen inches above the upper landing surface.  This condition exposed the employee to an approximate eleven foot fall hazard.
