29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portableladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps,walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall beused. Crossbraces shall not be used as a means of access. a) On or about April 12, 2012; on the east side of the jobsite, employees were allowed to climb scaffold cross-braces on a supported frame scaffold in order to access a scaffold level at a height of approx. twenty seven feet.

29 CFR 1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews. a) On or about April 12, 2012; on the east side of the jobsite, employees were allowed to stand on a scaffold platform while performing masonry work that did not have guardrail systems installed along all open sides and ends of the platform.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrailsystems, safety net systems, or personal fall arrest systems. a) On or about April 12, 2012; on the east side of the jobsite, employees were allowed to perform work while standing near the side and edge of a rooftop at a height of approximately 13ft. that was not protected by an appropriate fall protection system.
