29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use:    A written respirator program was not developed or implemented to include: medical evaluation, training, and cleaning, disinfecting, and storage of respirators. The use of a filtering facepiece (dust mask) was required during chipping of ready-mix  truck drums.

29 CFR 1910.146(c)(1): The employer shall evaluate the workplace to determine if any spaces are permit-required confined spaces:    The employer had not evaluated all employee workplaces for permit-required confined spaces such as the ready-mix concrete truck drums.  Employees were exposed to atmospheric and mechanical hazards associated with entering the truck drums for chipping out the accumulated concrete material buildup.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets:    Employees were exposed to hazardous chemicals in that they were not trained on the chemicals used at the facility such as but not limited to: concrete chemical additives and silica.

This paragraph requires the employer to evaluate respiratory hazard(s) in the workplace, identify relevant workplace and user factors, and base respirator selection on these factors. The paragraph also specifies appropriately protective respirators for use in IDLH atmospheres, and limits the selection and use of air-purifying respirators:    An exposure assessment for the ready-mix drum chipping process was not performed to determine whether dust masks provided adequate protection against silica exposure.

29 CFR 1910.146(c)(3): If the employer decides that its employees will not enter permit spaces, the employer shall take effective measures to prevent its employees from entering the permit spaces and shall comply with paragraphs (c)(1), (c)(2), (c)(6), and (c)(8) of this section:    The requirements contained in paragraphs (c)(1), (c)(2), (c)(6), and (c)(8) were not followed after a determination was made for employees not to enter permit-required confined spaces such as but not limited to: silos and mixers.
