29 CFR 1926.102(a)(1):     Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    a) 122 Route 130 South, Bordentown, NJ:  Employees were exposed to potential health hazards during while installing a fire resistant coating to the steel structure of a multi-story commercial office building under construction.  The material that was being applied was identified as Cafco 300, a powder identified as an eye irritant.  Employer did not provide the employee with effective eye protection.    Observed on or about 4/18/2012.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.1200(h)(1):     Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)    a) 122 Route 130 South, Bordentown, NJ: Workers onsite were observed installing a fire resistant coating to the steel structure of a multi-story commercial office building under construction.  The material that was being applied was identified as Cafco 300, listed on original packaging as a potential eye, lung and skin irritant as well as a potential cancer causing agent.   Employer did not provide employees with effective information and training on hazardous chemicals in their work area, nor were MSDS sheets or any other information available on-site to employees for this substance.   Observed on or about 04/18/2012.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
