29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by a guardrail system, safety net system, or personal fall arrest system, or an alternative fall protection measure that meets a provision described in paragraph (b) of 29 CFR 1926.501.     The employer does not protect employees from falling when working 6 feet or more above lower levels. This violation was observed at the construction site on July 16, 2013 where employees were exposed to a 11 ft. fall hazard when performing roofing work without fall protection.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falling when exposed to falls 6 feet or more above a lower level or ground.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed.    The employer does not ensure that ladders are being used only for purposes for which they were designed.  This violation was observed on or about July 16, 2013 at the jobsite where an employee was exposed to a fall hazard while working from an extension ladder without keeping the ladder close to the work.        Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all ladders are being used in ways for which they are designed.
