29 CFR 1910.424(c)(1): SCUBA diving was conducted without a standby diver available while a diver was in the water: On or about April 18, 2012, a standby diver was not available where SCUBA diving operations were being performed approximately 37 feet underwater by a diver inside the Lake O.H. Ivie Reservoir Pump Intake Structure. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a standby diver is available where SCUBA diving operations are performed.

29 CFR 1910.424(c)(3): A diver was not stationed at the underwater point of entry when SCUBA diving was conducted in enclosed or physically confining spaces: On or about April 18, 2012, a diver entered the 8 foot diameter intake shaft between the Lake O.H. Ivie Reservoir Pump Intake Structure approximately 37 feet underwater without another diver stationed at the point of entry of the confined space. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all divers entering confined spaces are provided with additional divers positioned at the points of entry of confined spaces.
