29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. a) On or about 4/19/12 at the Holiday Inn Express located at 4356 Commerce Drive, Batavia, New York; an employee that was using a Dewalt chipping gun was plugged into an extension cord for 120 volt power. The extension was not plugged into a ground fault circuit interrupter and there was no assured grounding conductor program in place. NO ABATEMENT CERTIFICATION REQUIRED
