29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  The employer does not provide employees a means of egress from trenches. This violation was observed on or about April 20, 2012 on the east side of the jobsite where employees working in trench more than 4 feet deep were exposed to slip and fall hazards where no ladder or other means of egress was provided.

29 CFR 1926.651(j)(2):  Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  The employer does not ensure that material is kept 2 feet or more from the edge of the trench. This violation was observed on or about April 20, 2012 on the northeast side of the trench where the spoil pile was placed at the edge of the trench exposing employees working in the trench to struck-by hazards.

29 CFR 1926.652(a)(1):  Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).   The employer does not ensure that trenches are protected from cave-ins exposing employees to crush-by hazards.  a) This violation was observed on or about May 20, 2012, on the east side of the excavation, where employees were exposed to a cave-in hazard while installing a concrete inlet in a trench more than 5' in depth without an adequate protective system.  b) This violation was observed on or about May 20, 2012, on the west side of the excavation, where employees were exposed to a cave-in hazard while engaged in installing a pipe to the retention pond in a trench more than 5' in depth without an adequate protective system.

29 CFR 1926.651(k)(2):  Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.  The employer does not ensure employees are removed from trench when the competent person found evidence of a hazardous condition.  This violation was observed on or about April 20, 2012, on the northeast side of the jobsite where the competent person did not remove exposed employees working in the trench performing pipe installation after the trench was found not to be adequately protected from cave-in hazards.
