OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: Well site: on or about April 11, 2012, employees engaged in the rigging down and moving of an oil/gas well drilling rig used a gin pole truck that had a severely damaged winch wire rope. The gin pole truck was used to lift rig components weighting thousands of pounds. This exposed the employees to the hazards of being struck by a falling load and/or being struck by the parting rope.

29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: Well site: On or about April 11, 2012, employees engaged in the rigging down and subsequent moving of an oil/gas well drilling rig used a large rough terrain forklift. The forklift front windshield was damaged and the forklift was in service.
