29 CFR 1926.451(b)(1):   Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)  On or about April 20, 2012, three employees were applying insulation to the exterior of the building under construction from tubular welded scaffolding without a fully planked work platform, exposing the employees to a fall hazard.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each work platform on a scaffold is fully planked.

29 CFR 1926.451(e)(1):   When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, strucure, personnel hoist, or similar surface was not used. Cross-braces were used as a means of access.  On or about April 20, 2012, two employees were accessing the tubular welded scaffolding to hang plastic over the windows of the building under construction without the use of a ladder, exposing the employees to a fall hazard.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are provided a ladder to access scaffolding.

29 CFR 1926.454(a):   The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  On or about April 20, 2012, two employees were working on the exterior of the building from tubular welded scaffolding without receiving scaffolding training from the employer, exposing the employees to fall hazards.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee required to work on scaffolding receives training.

29 CFR 1926.20(b)(1):   The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  On or about April 20, 2012, the employer did not develop a safety and health program to ensure employees are aware of the hazards they are exposed to on the job site, exposing employees to hazards such as, but not limited to being struck by falling objects.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a safety program is developed to ensure employees are aware of hazards in the workplace.
