29 CFR 1910.424(c)(1): SCUBA diving was conducted without a standby diver available while a diver was in the water: On or about April 18, 2012, a diver was collecting a sediment sample from the bottom of the pump intake structure approximately 37 feet deep without a standby diver present. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a standby diver is present when SCUBA diving operations are performed.

29 CFR 1926.605(d)(2): The employer did not ensure that there was in the vicinity of each barge in use at least one U.S. Coast Guard-approved 30-inch lifering with not less than 90 feet of line attached. On or about April 19, 2012, employees were utilizing the barge to operate the excavator for lifting the gates of the intake pump structure and to stage rescue operations without a lifering in the vacinity of the barge, exposing the employees to a water hazard. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure each barge that employees are working on has a U.S. Coast Guard-appoved lifering with at least 90 feet of rope.
