29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: As of 04/23/2012 during the forming and pouring of concrete footers, at an excavated site that measured approximately 80 feet by 18 feet, at a depth of 10-11 feet; the employer failed to ensure that daily inspections to identify potentially hazardous conditions were completed by a competent person. Responsibilities of the Competent Person includes, but are not limited to, assessing the soil type to determine appropriate cave-in protection is being utilized, ensuring that appropriate means of egress are established, assessing weather conditions to determine if the excavation has been compromised (e.g. : water accumulation and/or fissures).
