29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. A. Samuel Graber LP worksite located at 7950 Maumee Western Rd., Maumee, Ohio: On or about April 24, 2012 the employer did not ensure an employee was wearing proper eye protection while operating a pneumatic nail gun to install wall studs and secure sheets of plywood on a residential structure. The employee was exposed to potential flying object hazards while operating the pneumatic fastener on the east side of the structure. B. Samuel Graber LP worksite located at 7950 Maumee Western Rd., Maumee, Ohio: On or about April 24, 2012 the employer did not ensure an employee was wearing proper eye protection while operating a circular saw while cutting sheets of plywood for a residential structure. The employee was exposed to potential flying object hazards while operating the hand held saw on the east sid eof the structure.

The employee was exposed to a potential fall distance of approximately 10 feet. B. Samuel Graber LP worksite located at 7950 Maumee Western Rd., Maumee, Ohio: On or about April 24, 2012, the employer did not ensure employees were protected from falls while installing wall studs on the east gable of the residential structure near the ridge. The employee was exposed to a potential fall distance of approximately 18 feet.
