OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards: On April 17, 2012 and times prior thereto, where at least one storage rack in the warehouse had damaged columns and column base plates that were displaced from the anchor bolts; exposing employees to struck-by and crushing hazards from the contents of the racks.
