29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s): a) Burns Iron & Metal Co. - Fremont, Ohio: On or about April 17, 2012, the employer did not assure that employees were protected from the point of operation while operating the JMC Recycling Systems alligator shears (model 640). Employees that operated the shear were exposed to amputation hazards in that point of operation guarding was not utilized.

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition. a) Burns Metal & Iron Co. - Fremont, Ohio: On or about April 17, 2012, the work floor adjacent to the JMC Recycling Systems alligator shear was not kept clear of metal scrap parts. Metal parts surrounding the machine did not allow for a clear walking/working area, exposing employees to trip hazards.
