29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provisionin paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it isinfeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets therequirements of paragraph (k) of 1926.502. a. On or about April 24, 2012 - at the above addressed jobsite, employees performing sheathing operations on a roof more than twenty five (25) feet above the ground were not protected from falls, thereby exposing employees to fall hazards. b. On or about April 24, 2012 - at the above addressed jobsite, employees were exposed to falls of nine (9') feet three (3") inches due to unprotected loft area on the first floor, thereby exposing employees to fall hazards. c. On or about April 24, 2012 - at the above addressed jobsite, employees were exposed to falls of six (6) feet seven (7) inches due to unprotected window openings on the 1st floor, thereby exposing employees to fall hazards. d. On or about April 24, 2012 - at the above addressed jobsite, employees were exposed to falls of six (6) feet in to a basement, created by the presence of a wall opening, thereby exposing employees to fall hazards.

29 CFR 1926.1052(c)(1)(i): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, shall be equipped with at least one handrail. a. On or about April 24, 2012 - at the above addressed jobsite, the stairway to the second floor was not provided with handrails, thereby exposing employees to fall hazards of approximately fifteen (15) feet.
