29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. The employer does not ensure that employees use ladders, stair towers or stairway-type ladders to access an upper level. This violation was observed on or about March 21, 2012, where employees were exposed to a fall hazard when standing on the top rails of a mobile scaffold while performing steel erection activities and accessing another structure.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. The employer does not ensure that employees engaged in steel erection activities on a walking/working surface with an unprotected side or edge 15 feet or move above a lower level are protected from falling. This violation was observed on or about March 21, 2012, on the Southeast side of the construction site, where employees were exposed to a 19 foot fall hazard when performing steel erection activities without fall protection system. STEEL MASTERS L.P. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(b)(1) , WHICH WAS CONTAINED IN OSHA INSPECTION 313122608, CITATION NUMBER 1, ITEM NUMER 1 AND WAS AFFIRMED AS FINAL ORDER ON 5-28-2009 WITH RESPECT TO A WORKPLACE LOCATED AT 23400 HEGAR HOCKLEY, TX. 77477.
