29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. The employer does not ensure that each powered industrial truck operator has successfully completed the training program consisting of a combination of formal instruction, practical training, and evaluation. This violation was discovered on April 17, 2012, when employees were operating the Magnum Y3000 without having been provided formal instruction and on evaluation of the operator's performance in the workplace. Pursuant to 29 CFR 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the requirements, and describing the steps that it is taking to ensure that each powered industrial truck operator had successfully completed the training consisting of a combination of formal instruction, practical training, and evaluation.
