29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). (a)(LOCATION)(DIMENSIONS OF THE EXCAVATION)(EMPLOYEES EXPOSED)(THE EMPLOYER HAD NOT MET ALL THE ELEMENTS OF SLOPING/BENCHING OPTION (2), -3 OR (4)) NOTE: THIS OPTION IS FOR USE WHEN SLOPING IS INADEQUATE. SEE CPL 2.87, DATED FEBRUARY 20, 1990, REQUIREMENTS FOR PROTECTIVE SYSTEMS, (d)(1)(a) AND (b), PAGE 13 (a) Letterkenny Waste Water Treatment Plant - Aeration Chamber - An employee was installing re-enforcing steel for concrete in the excavation that was nineteen feet squared and eleven feet deep with no shoring, on or about April 19, 2012. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records

The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
