29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    a)  Elite, LLC on or about April 25, 2012, at the address of 5715 W. Central Ave. Toledo, OH: The employer did not ensure employees were wearing appropriate eye protection such as, safety glasses while using a gas power circular saw to cut masonry block. The employee using this tool without eye protection was exposed to potential eye injuries from flying particles.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity):    a) Elite, LLC on or about April 25, 2012, at the address of 5715 W. Central Ave. Toledo, OH: The employer failed to ensure employees were adequately protected from a fall while working from a supported scaffold at the east wall of a commercial structure. Employees performing overhand bricklaying from the scaffolding platform without standard railing were exposed to a 13ft fall to the ground below.
