29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a. On or about 04/19/2012, Daniel Construction Co, Inc., # 481-1 Estate Chocolate Hole, St John V.I. retaining wall construction area: The employees were working over wood form scaffold attached to form wall of 12-6 feet high from the lower level without a conventional fall protection system, such as guardrail, safety net, or personal fall arrest system in place. NOTE 1: Daniel Construction Co, Inc. was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.451(g)(1)(vii) which was contained in the OSHA Inspection Number # 313534034, Citation 1, Item number 2 (a), issued on 04/07/2011, with respect to a work place located at 7-8th Street Estate Thomas, St. Thomas VI 00801. NOTE 2: Certification of abatement is not required for this citation item as abatement was documented by the compliance safety and health officer during the inspection.
