5(a)(1) Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: On or about April 19, 2012, and at time prior thereto, at the facility employees were observed working from a personnel platform mounted to a lift truck and raised to a height over ten feet. The personnel platform was not provided with attachment means and not securely attached to the lifting carriage or forks. The employee were exposed to hazards of falling, dropped on and/or struck by.

1910.28(d)(7) Guardrails of metal welded frame scaffolds were less than 36 inches high. On or about April 19, 2012, and at times prior thereto, in the shop areas employees were allowed working from a personnel platform mounted onto a forklift truck and raised to a height more than ten feet high. The top rail of the platform was measured to be less than 36 inches high. Employees were exposed to fall hazard.
