29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:      a) Northwest corner of the site, adjacent to the site entrance; On or about April 25, 2012 and at times prior thereto, employees installing a concrete manhole structure and related PVC wastewater piping in an excavation up to 13 feet deep with nearly vertical excavated walls were utiliziig the excavated slope for access in/out of the excavation. Sections of the slope exceed 45 degrees.    Note: Abatement certification or documentation is NOT required for this item.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:      a) Northwest corner of the site, adjacent to the site entrance; On or about April 25, 2012 and at times prior thereto, the employer's competent person did not determine the hazards associated with an excavation up to 13 feet deep with nearly vertical excavated walls prior to allowing employees installing a concrete manhole structure to enter the excavation. 29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    a) Northwest corner of the site, adjacent to the site entrance; On or about April 25, 2012 and at times prior thereto, employees installing a concrete manhole structure and related PVC wastewater piping in an excavation up to 13 feet deep with nearly vertical excavated walls were not provided with a means of protection.    b) Northwest corner of the site, east end of the excavation; On or about April 25, 2012 and at times prior thereto, an employee assisting the excavator operator in backfilling around a concrete manhole structure and related PVC wastewater piping was not provided with a means of protection.
