29 CFR 1926.1431(a): The employer did not demonstrate that the erection, use, and dismantling of conventional means of reaching the work area, such as a personnel hoist, ladder, stairway, aerial lift, elevating work platform, or scaffold, would be more hazardous, or is not possible because of the project's structural design or worksite conditions during the use of equipment to hoist employees. This paragraph does not apply to work covered by subpart R (Steel Erection) of this part: On or about April 18, 2012, an employee was exposed to falls up to 30 feet from a lower level and struck by hazards while being hoisted by a Mantis Crawler Cranes on the site where conventional means such as an aerial lift, elevated work platform, or a scaffold could have been used.
