29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions. a) South side of structures; On or about April 25, 2012 and at times prior thereto, an employee was nailing exterior wall sheathing with a pneumatic nail gun was not wearing eye protection. b) South side of structures; On or about April 25, 2012 and at times prior thereto, an employee utilizing a 7 1/4 inch worm drive circular saw to cut wood materials was not wearing eye protection. c) South side of structures; On or about April 25, 2012 and at times prior thereto, employees working on/around a rough terrain material lift being used to hoist a work platform and other overhead activities were not wearing hard hats. Note: Abatement certification is NOT required for this item.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied: a) South side of structures; On or about April 25, 2012 and at times prior thereto, an employee was nailing exterior wall sheathing while being elevated by a rough terrain material lift with a platform that was not attached to the forks. b) South side of structures; On or about April 25, 2012 and at times prior thereto, an employee was nailing exterior wall sheathing was remaining on a platform elevated by a rough terrain material lift that was moving back and forth to reposition the employee to the next section of the facade. Note: Abatement certification is NOT required for this item.
