29 CFR 1910.1001(j)(2)(i):     Building and facility owners shall determine the presence, location, and quantity of ACM and/or PACM at the work site. Employers and building and facility owners shall exercise due diligence in complying with these requirements to inform employers and employees about the presence and location of ACM and PACM.    a. On or about April 27, 20012 - at the above addressed jobsite, the employer did not inform employees of the presence or location of asbestos containing materials, thereby exposing the employees to the hazavrds associated with asbestos exposure.

29 CFR 1910.1001(j)(2)(ii):     Building and facility owners shall maintain records of all information required to be provided pursuant to this section and/or otherwise known to the building owner concerning the presence, location and quantity of ACM and PACM in the building/facility. Such records shall be kept for the duration of ownership and shall be transferred to successive owners.    a. On or about April 27, 2012 - at the above addressed jobsite, the building and facility owners did not provided and maintain the records concerning the presence, location, and quantity of ACM/PACM in the builidng, thereby exposing the employees to asbestos hazards.

On or about April 27, 2012 - at the above addressed jobsite, the employer did not inform employees who performed housekeeping activities in areas which contain ACM and/or PACM of the presence and location of the ACM and/or PACM, thereby expsoing the employees to asbestos hazards.

29 CFR 1910.1001(j)(7)(iv):     The employer shall also provide, at no cost to employees who perform housekeeping operations in an area which contains ACM or PACM, an asbestos awareness training course, which shall at a minimum contain the following elements: health effects of asbestos, locations of ACM and PACM in the building/facility, recognition of ACM and PACM damage and deterioration, requirements in this standard relating to housekeeping, and proper response to fiber release episodes, to all employees who perform housekeeping work in areas where ACM and/or PACM is present. Each such employee shall be so trained at least once a year.    a. On or about April 27, 2012 - at the above address jobsite, employees conducting housekeeping operations were not trained to recognize the hazards of asbestos and the procedures to be followed in order to minimize these hazards, thereby exposing the employees to asbestos hazards.
