29 CFR 1910.215(b)(9): Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, were not constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel.  The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section shall never be exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed one-fourth inch:  (a) In the shop on or about April 27, 2012, and at times prior thereto, the tongue guards were not within one quarter inch both abrasive wheels on a Porter Cable bench grider, model number PC 857586, serial number 020769.  The tongue guards were about one half inch from the wheels.  The grinder was used to sharpen chisels and metal parts.

29 CFR 1910.212(b): Machines designed for a fixed location were not securely anchored to prevent walking or moving:  (a) In the shop on or about April 27, 2012, and at times prior thereto, a Delta 8 inch drill press was not secured to the table.  There were holes in the drill press base to mount it to a surface.  The drill press was used to drill holes in metal for new slot machine bases.  There were metal shavings on the table.
