29 CFR 1910.23(a)(2): Every ladderway floor opening or platform was not guarded by a standard railing with standard toeboard on all exposed sides (except at entrance to opening), with the passage through the railing either provided with a swinging gate or so offset that a person cannot walk directly into the opening: (a) Central Slide Platform: Employees accessed the central slide platform to perform tasks such as cleaning out the slide and accessing the silo. Employees were exposed to a fall to ground of approximately 10 feet, in that the ladderway opening was not offset and was not provided with a swinging gate, as determined on April 20, 2012. (b) Central Mix Drum Platform: Employees accessed the mix drum platform on a daily basis to perform task such as greasing fittings and cleaning out the chute. Employees were exposed to a fall to the ground of approximately 15 feet, in that the ladderway opening was not offset and was not provided with a swinging gate, as determined on April 20, 2012.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: (a) Central Mix Drum platform: Employees accessed the mix drum platform and were exposed to the rotating drum protruding bolt heads that were approximately 4 1/4 inches away from the top railing. The bolt heads protruded out from the surface of the rotating mix drum 9/16ths of an inch and were not guarded to prevent contact with employees, as determined on April 20, 2012. Abatement Certification Required For This Item.
