29 CFR 1926.1101(k)(4): Employer who discovered asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) on a worksite did not convey information concerning the presence, location and quantity of such newly discovered asbestos containing material and/or presumed asbestos containing material to the owner and to other employer(s) of employees working at the worksite within 24 hours of discovery:    a) Cushman & Wakefield,Inc., facility manager at Kraft Foods Global, Inc., worksite at 801 Waukegan Rdoad, Glenview, IL, did not ensure that the information regarding the damaged/disturbed asbestos containing insulation from a hot water tank was conveyed within 24 hours of receiving the results to Guardsmark, the security guard company.  Security guards enter and patrol the affected area, Boiler Room, Building # 4, as part of their rounds every 2 hours, around the clock, 24 hours per day, 7 days per week. The asbestos results were received on 3/10/12 and Guardsmark was notified on 3/13/12.

29 CFR 1926.1101(k)(8)(vii): After the building owner or employer identified previously installed presumed asbestos containing material (PACM) and/or asbestos containing material (ACM), labels or signs were not affixed or posted so that employees would be notified of what materials contain PACM and/or ACM, and/or the employer did not post signs in lieu of labels, and/or ensure, to the extent feasible, that employees who come in contact with these signs or labels could comprehend them:    a) Upon receipt on 3/10/12 of the results that the damaged/disturbed hot water tank insulation that fell onto the floor contained 20-25% amosite and 10-15% chrysotile asbestos, Cushman & Wakefield,Inc., facility manager at Kraft Foods Global,  worksite at 801 Waukegan Rd., Glenview, IL, did not ensure that labels/signs were affixed/posted so that workers who frequent the affected area, including Guardsmarks security guards whose patrol include entering the Boiler Room in Building #4, would be notified of the materials containing PACM/ACM, and that the workers would understand the labels/signs.
