Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls: a. Site - Employees were standing inside the bucket of a bobcat (model S250) skid steer which was elevated approximately 11 1/2 feet in the air, exposing them to a fall to the ground. ABATEMENT NOTE: Among other methods, one feasible and acceptable means of abatement is to not permit workers to be elevated by the Bobcat skid steer utilizing the bucket attachment. (1) Other feasible methods would be to provide adequate ladders to perform this task and ensure that employees have received training on the safe use of ladders. Inform the employees of the manufacturer's instructions for proper use of the ladder. Ensure ladders are used in accordance with manufacturers instructions. (2) The employer could provide a scaffolding system and train the employees in the requirements for scaffolding systems.
