OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to tip over hazard due to an unauthorized counterweight being mounted on the back of the LULL 844C-42 Rough Terrain Forklift. a. On or about April 27, 2012 - at the above addressed jobsite, an employee was unloading precast members from a flat-bed truck using a LULL 844C-42 Rough Terrain Forklift with a unauthorized counterweight attached to the back of the forklift, thereby exposing the employee to a tip over hazard.

On or about April 27, 2012 - at the above addressed jobsite, the employer did not initiate and maintain an accident prevention program and/or safety and health program to comply with the regulations of this part which included, but were not limited to employee protection when exposed to falls, tip-overs as well as struck by/caught in between.

29 CFR 1926.501(b)(12): "Precast concrete erection." Each employee engaged in the erection of precast concrete members (including, but not limited to the erection of wall panels, columns, beams, and floor and roof "tees") and related operations such as grouting of precast concrete members, who is 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, or personal fall arrest systems, unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a. On or about April 27, 2012 - at the above addressed jobsite, an employee installing precast concrete members approximately nine (9) feet above the ground was not protected from falls, thereby exposing the employee to fall hazards.
