OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards due to the possibility of the load breaking free from the slings and/or chains.    a.  On or about April 27, 2012 - at the above addressed jobsite, an employee was operating and lifting large precast concrete members using lifting chains in conjunction with lifting straps placed around the structure of a LULL 844C-42 Rough Terrain Forklift when this practice is not recommended and or approved by the manufacturer, thereby exposing the employee to a struck by hazards due to a possibility of the load breaking free from the chains and or slings.    Among other methods, feasible and acceptable abatement methods include following the requirements for protecting personnel explained in a letter from JLG Industries, Inc. (JLG Lifting Hook Attachment) dated September 4, 2007 which states that; The use of chains and/or straps attached directly to the forks, load bar, carriage or quick attach is not authorized as the quick attach or mast carriage could be damaged due to improper loading and the load could come in contact with or slide off of the forks causing damage or loss of the load.  In addition, the employer can purchase or rent the appropriate attachments, i.e. truss boom or crane hook to replace the existing forks.  Either of these two attachments are better suited and approved for this type of work.    b.  On or about April 27, 2012 - at the above addressed jobsite, an employee was working under a suspended load (precast concrete members), thereby exposing the employee to a struck by hazards due to the load abruptly swinging in to the employee and or crushing hazards due to a possibility of the load breaking free from the chains and or slings.    Section 6.2.7 ANSI/ASME B56.6-2002 Safety Standard For Rough Terrain Forklift Trucks states; Do not allow anyone to stand or pass under the elevated portion of any rough terrain forklift truck, whether empty or loaded.

29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.    a.  On or about April 27, 2012 - at the above addressed jobsite, the employer did not initiate and maintain an accident prevention program and/or safety and health program to comply with the regulations of this part which included, but were not limited to employee protection when exposed to falls, and struck by/caught in between.

29 CFR 1926.501(b)(12): "Precast concrete erection." Each employee engaged in the erection of precast concrete members (including, but not limited to the erection of wall panels, columns, beams, and floor and roof "tees") and related operations such as grouting of precast concrete members, who is 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, or personal fall arrest systems, unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.     a.  On or about April 27, 2012 - at the above addressed jobsite, an employee installing precast concrete members approximately nine (9) feet above the ground was not protected from falls, thereby exposing the employee to fall hazards.
