29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). On or about April 17, 2012; no protective devices, effective benching or sloping were in place to protect an employee while working in a trench, exposing the employee to the hazard of being crushed by collapsing soil. BREWER CONSTRUCTION WAS PREVIOUSLY CITED TWICE FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.652(a)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBERS: 314928847, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON MARCH 8, 2011 WITH A FINAL ABATEMENT DATE OF FEBRUARY 16, 2011, WITH RESPECT TO A WORKPLACE HAZARD AT DEAN MCGEE AND ROBINSON ST. IN OKLAHOMA CITY, OK. 314933730, CITATION NUMBER 2, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON NOVEMBER 25, 2011 WITH A FINAL ABATEMENT DATE OF NOVEMBER 7, 2011, WITH RESPECT TO A WORKPLACE HAZARD AT 10 NORTH KINBELL IN YUKON, OK.
