29 CFR 1910.134(e): The employer did not provide a medical evaluation to  determine the employee's ability to use a respirator before the employee was  fit tested or required to use the respirator in the workplace.     a). On or about 5/2/12, in the cleaning line, for employees that fill the tanks with hydrofluric acid and nitric acid, 2-3x a week; transferring from a 55 gallon drum via a hand pump. The employer required employees to don a North 75SCP100 full face respirator. The employer did not provide a medical evaluation to the employees.

29 CFR 1910.134(f): The employer failed to ensure that employees using a tight fitting face piece respirator (including a filtering face piece) pass an appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT) as  stated in this paragraph      a). On or about 5/2/12, in the cleaning line, for employees that fill the tanks with hydrofluric acid and nitric acid, 2-3x a week; transferring from a 55 gallon drum via a hand pump. The employer required employees to don a North 75SCP100 full face respirator. The employer did not provide a fit test.
