29 CFR 1926.501(b)(13) Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: 1) At the jobsite, employees were installing felt paper on a residential roof whose slope was measured at approximately 5:12. The ground to eave height was approximately 20 feet. Neither conventional fall protection or in the alternative were in place.

29 CFR 1926.1053(b)(1) Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: 1) At the jobsite, the side rails belonging to a Werner portable extension ladder exceeded the eave by approximately one foot. RCA CONSTRUCTION was previously cited for a violation of the Occupational Safety and Health Standard or its equivalent standard 29CFR 1926.1053(b)(1), which was contained in OSHA Inspection number 315814194, Citation 1, Item 1, issued on 8/10/2011, and became Final Order on 09/02/2011.
