29 CFR 1926.21(b)(1):   An accident prevention program had not been initiated by the employer:    At the job site located at 7381 W. 133rd, suite 303, Overland Park, Kansas, employee(s) engaged in plumbing activities were exposed to physical injuries due to no safety and health programs being developed and implemented to address the steps necessary to eliminate or reduce construction hazards such as working with tools, covering floor openings, ladder safety, falls, electrical safety, and etc.

29 CFR 1926.21(b)(2):  The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    Employee(s) at the job site had not received training to avoid unsafe conditions such as electrical safety, covering floor openings, ladder safety, electrical safety, and etc.  The employee(s) at the job site were not trained over the OSHA regulations that apply to their construction work or how to eliminate work job site hazards.

29 CFR 1926.250(b)(1): Material inside building(s) under construction was stored within 6 feet of hoistway(s) or inside floor opening(s):    On or about April 30, 2012, a 10 foot metal copper pipe was placed inside the metal studs of a frame wall under construction.  The 10 foot metal pipe was within 3 inches of a floor opening that was not covered.  The 10 foot copper pipe fell through the floor opening and penetrated the ceiling of the company on the floor below hitting the keyboard on the office manager's workstation, thus exposing another company's employee to physical injuries.
