OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard of approximately 9 feet 10 inches while welding on the top hatch of a tanker truck without fall protection.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees use fall protection while working at heights greater than four (4) feet.

29 CFR 1910.106(e)(2)(iv)(a):     Flammable liquids were uncovered when not in use:    On or about May 2, 2012, and at times prior thereto, two one-gallon containers of Rust-Oleum, and one one-gallon container of PRISM 3.5 VOC Acrylic Urethane stored in the flammable storge shed were not kept closed while not in use.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that flammable materials are kept sealed when not in use.

29 CFR 1910.107(b)(5)(i):     Visible gauges or audible alarm or pressure activated devices were not installed to indicate or insure that the required air velocity was maintained:    On or about May 2, 2012, and at times prior thereto, gauges or alarms were not installed in the paint booth to ensure the required air velocity was maintained in the areas to prevent build up of flammable vapors and paint overspray.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that air flow gauges or alarms are installed in the spray booth.

29 CFR 1910.107(f)(1):     Sprinkler heads were not located so as to provide water distribution throughout the entire booth:    On or about May 2, 2012 and at times prior thereto, the employer did not ensure that sprinkler heads were installed in the spray booth.  The employer utilizes epoxy primer and urethane based paint which are Class 1A and 1C flammable liquids.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that sprinkler heads are installed in the spray booth.

29 CFR 1910.157(g)(2):     The educational program to familiarize employees with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting was not provided to all employees upon initial employment, and at least annually thereafter:    On or about May 2, 2012 and at times prior thereto, the employer did not provide annual fire extinguisher training to employees who may use the device to fight incipient stage fires.  The employers written fire extinguisher training plan gives the employees a choice to put out fires or leave the building.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees that are expected to fight fires are trained at least annually in the proper use of fire extinguishers.
