OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard of approximately 9 feet 10 inches while welding on the top hatch of a tanker truck without fall protection. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees use fall protection while working at heights greater than four (4) feet.

29 CFR 1910.157(g)(2): The educational program to familiarize employees with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting was not provided to all employees upon initial employment, and at least annually thereafter: On or about May 2, 2012 and at times prior thereto, the employer did not provide annual fire extinguisher training to employees who may use the device to fight incipient stage fires. The employers written fire extinguisher training plan gives the employees a choice to put out fires or leave the building. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees that are expected to fight fires are trained at least annually in the proper use of fire extinguishers.
