OSH ACT of 1970 Section (5)(a)(1):     Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing for likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards while operating Rollover Protective Structure (ROPS) equipped earthmoving machines and they were not wearing the supplied seatbelts.    (a)    West Side of Site - On or about April 25, 2012 an employee was operating a Caterpillar Bulldozer equipped with a ROPS structure and he was not protected by wearing his provided seatbelt.    (b)   West Side of Site -On or about April 25, 2012 as employee was operating a Caterpillar Compactor, Model CS-433C, which was equipped with a ROPS structure and he was not protected by wearing his provided seatbelt.
